Abstract
Azken hamarkadotan garatu den paradigma neoliberala hegemoniko gisa aldarrikatu da eta gizabizitzaren esparru guztiak gainezkatu ditu; tartean, Estatua eta konstituzio-zuzenbidearen kategoriengain eraldaketa sakonak eraginez. Marko analitiko zabal batetik abiatuz, gaiaren hiru kategoria nagusiditugun neoliberalismoa, Estatua eta konstituzio-zuzenbidearen definizio alternatibo bat eskainiko dugu.Definizio horiek zentzu bikoitzean jardutera gaitzen gaituzte: lehenik, neoliberalismoak Estatu etaKonstituzioaren gain eragindako transformazio horiek prozesu desozializatzaile, desdemokratizatzaileeta teknokratizatzaile gisa identifikatzera; gerora, konstituzio-zuzenbidea Estatu sozial etademokratikoaren hustearen aurrean balazta gisa erabili daitekeen tresna moduan irudiztatzeko.
In recent decades, the neoliberal paradigm has been proclaimed as hegemonic and has inundatedeach and every space of human life, promoting, in turn, profound changes in the State and constitutionallaw. Starting from a broad theoretical framework, we could offer an alternative definition of the threecategories on which our work pivots: Neoliberalism, the State and Law. These definitions allow us todiscourse in a double sense: not just to understand that neoliberalism has transformed both the Stateand Constitucional law in a desocializing, de-democratizing and technocratizing way; but to conceive ofConstitutional law as the brake on an emptying of the social and democratic elements of the State.
