Trantsizio-ondorengo justizia Euskal Autonomia Erkidegoan
Abstract
Ikerketa honen helburua da gerla zibila eta frankismoaren biktimei buruz EAEn gaur aplikatzen diren legezko tresnak lantzea, trantsizio-ondorengo justiziaren baitan. Trantsizio demokratikotik bizpahiru hamarkada pasa eta, trantsiziozko justiziaren tresna batzuk (egiaren, justiziaren, erreparazioen eskubideak eta ez-errepikatzeko bermeak) aplikatuak dira, normalean trantsizio demokratikoaren garaian erabiltzen direnean giza eskubide urratze masiboak kudeatzeko. Honen ondorio bat da biktima berri batzuk agerrarazten dituela, biktimen inguruko egoera korapilatsu batean, non giza eskubide berriak aipatzen baitira. EAEko adibidea aztertuz, trantsizio-ondorengo justiziaren tresnen aplikazioaren desafio juridikoak identifikatzen ahal dira.
This research aims to analyze the legal instruments dedicated to the victims of the Spanish Civil War and the Franco regime in the Basque Autonomous Community (BAC), through the lens of the post-transitional justice (PTJ) concept. Indeed, several decades after the democratic transition, instruments of transitional justice (the right to truth, justice, reparation and guarantees of non-repetition) are still being applied, when they are traditionally only used during a democratic transition, in order to manage the massive violations of human rights. This causes the emergence of new victims in the BAC, within an already complex victim context, in which new human rights emerge. Through the example of the BAC, it is thus proposed to identify the legal challenges involved in the application of PTJ tools.
