Ziurgabetasunean erabakitzen: nanomaterial manufakturatuen tratamendu juridikoa

Abstract

Nanoteknologiek, materialak nano-eskalan (10-9) manipulatuz beren propietate desberdinak eta probetxugarriak bilatzen dituzten teknologia multzoak, hazkuntza nabarmena izan dute azken hamarkadan. Nanomaterial manufakturatuen ustiapen teknikoen ezagutza maila abiadura bizian hazten ari da; ez, ordea, osasunean eta ingurumenean eragin ditzaketen arrisku potentzialen ezaguera, alor horretan ziurgabetasun zientifikoa nagusi baita. Arrisku konplexu eta ziurgabe horiek zuzenbidearen jardute eremuan kokatzen diren aldetik, artikulu honek hauxe landu du: arrisku horien onargarritasunaren gainean erabakiak eta neurri juridikoak adostean, kontuan hartu beharreko zenbait elementuren proposamena eta horien gaineko hausnarketa.

Nanotechnologies, the group of technologies that through the manipulation of materials on nano-scale (10-9) seek their different and beneficial properties, have experienced substantial growth over the past decade. Although the knowledge level about the technical exploitation of the manufactured nanomaterials is enhancing at a great rate, the same cannot be said about the knowledge of their potential risks on health and environment, still dominated by a large scientific uncertainty. These complex and uncertain risks enter within the sphere of action of the law and hence, this article proposes and reflects on the elements to be taken into account when deciding on the tolerable level of risk and adopting legal measures on the matter.
